Antioch concrete beam manufacturer fined $3.5 million for high pH discharges
One of 72 Clean Water Act Criminal Prosecutions in the State of California (from 1989-2023)
The defendant in this case is a pre-cast cement beam and girder manufacturer based in Antioch. The business was charged and convicted on a single count violation of the Clean Water Act for knowingly releasing a pollutant, high pH wastewater to the San Joaquin River.
As part of its operations, the defendant manufactured and poured cement into casting beds to form piles for building construction, girders and beams for bridge construction, among other concrete products. During the process, high pH industrial process water is produced.
The defendant's plea agreement disclosed that during the period Jan 2004 to April 2007, employees routinely discharged untreated concrete process water via hose to a stormwater drain. The contaminated water had a pH well above the limit established in the discharge permit for the business and above the established level for the San Joanquin River generally.
Federal Court Justice for California sentenced the defendant to a fine of three and a half million dollars, and three years probation.
Federal Fine: $3,500,000; Probation: 36 months
