Dead ducks found in an oil slick tracked to a vessel in San Diego Bay

One of 72 Clean Water Act Criminal Prosecutions in the State of California (from 1989-2023)

The defendant in this case was the operator of a marine vessel in San Diego Bay. Dead ducks and an oil spill tracked back to the vessel prompted an investigation of the source. Investigators found a sump pump in the engine room intentionally set to discharge oily water into the bay. The composition of a sample taken from the spill matched the material found on board the vessel.

The defendant was charged with three counts of violation of the Clean Water Act for knowing discharge of contaminant into US waters.
The defendant plead guilty to three charges of intentional release of contaminants in violation of the Clean Water Act. Sentencing included a federal fine, a period of probation and restitution ordered for the cost to clean up the spill.

Federal Fines: $7,500; Restitution: $14,608; Probation: 8 months
