Co-conspirators sentenced to prison and probation for illegal dumping of in San Francisco Bay

One of 72 Clean Water Act Criminal Prosecutions in the State of California (from 1989-2023)

The defendants in this case are the manager of a marine services company and the captain of one of the company's vessels operating in San Francisco Bay. Evidence presented to the U.S. District Court in Northern California showed from 2003 to 2007, the defendants participated in "routine discharge of large amounts of contaminated and toxic dredged spoils into navigable waters of the United States without a permit." The manager was found personally involved in the illegal dumping while also conspiring with company employees, ordering company employees to carry out the Clean Water Act crimes. The defendants were present and involved in opening the hull of a barge off shore of Winter Island in Contra Costa County, allowing the dredge material contained in the barge to contaminate the water around Winter Island.

The company had previously been charged, plead guilty and sentenced $1.5 million in fines, restitution and ordered environmental compliance planning measures for this incident. The company involved in this case did hold a valid permit to dispose of dredge material on Winter Island at the time of the incidents. Rather than offloading the contaminated dredge material to the disposal site on land, the defendants conspired to dump into the water.

Prison time: 21 months; Federal Fine: $2500; Community Service: 450 hours; Probation: 60 months
